The State Election Commission of Sikkim is a constitutionally mandated authority established under Article 243K of the Constitution of India, which vests superintendence, direction and control of the preparation of Electoral rolls and the conduct of elections to Panchayats and Municipalities in the State. Article 243ZA extends the same mandate to elections to Urban local bodies to be conducted in a free and fair manner.
Under the provisions of Section 13 of the Sikkim Municipalities Act, 2007, each Municipality shall consist of such members of councillors, categorised into larger urban areas or smaller urban areas, and areas that are in transition - from a rural area to an urban area. These factors are taken into account to constitute a Municipal Corporation, Municipal Council and Nagar Panchayat. The size of the populations is also taken into account before finalising the minimum and maximum numbers of councillors to be elected.
