Section 4(b) (i)  ORGANISATION, FUNCTIONS AND DUTIES.

 

  1. Home Department, being the nodal agency in the administrative structure of the Government of Sikkim, endeavors to bring coordination amongst the various departments and oversees the implementation of the Government’s policies and programmes in the State. It also looks after administrative matters relating to the offices of the Chief Minister and Council of Ministers. The management of the Tashiling Secretariat, State Guest House, Circuit House, Chintan Bhawan is under the control of Home Department. It also exercises general supervison over the Sikkim House, New Delhi including booking of rooms in New Sikkim House at Gangtok and allotment of earmarked quota for train bookings. Finance and administrative matters of the State Jail and the Rajya sainik Board are also dealt by the Home Department.

 

 

  1. The Department is housed in the ground floor, first floor and second floor of Tashiling Secretariat, Gangtok. The Department is headed by a Additional Secretary who is assisted by two Additional Secretaries, one Director, one Joint Secretary, two Deputy Secretaries, five Under Secretaries, one Joint Director, one Assistant Engineer (mechanical), one OSD, Manager and a range of subordinate staff.

  1. Under the Government of Sikkim (Allocation of Business) Rules, 2004, the Home Department has been allocated the following subjects:

1.      General Administration,

2.      Administration of Justice,

3.      Internal Security,

4.      Business of Departments – distribution of work among departments,

5.      Assumption of office by Governer, Police, Public Order,

6.      Business Rules and Secretarial Instruction,

7.      Establishment side of the Council of Ministers- arrangements for meetings,

8.      Cipher-Cipher correspondence,

9.      Office Procedure,

10.  Political Offences-prosecution and withdrawal thereof,

11.  Jurisdiction and power of Courts except High Court,

12.  Matters relating to Citizenship,

13.  Sikkim Vigilance Police,

14.  State Jail

15.  Rajya Sainik Board,

16.  Police

17.  Public Order

18.  Private Security Agencies (Regulation) Act, 2005.

And under Secretariat which is presently looked after by the Home Department, following Government business are allotted:

5.      Visits of high personages-very important personages

6.      Flags-flying of

8.      Ceremonials

9.      Pool Transport – Government Vehicles

11.  Public Services – Statutory rules of the services with which the Department is

The Department also looks after ceremonial State functions, visiting  dignitaries and State Guests, and matters relating to swearing-in of Governor, Chief Justice, Chief Minister and the Council of Ministers, Sikkim House and New Sikkim House in New Delhi.

 

4.                  The above subjects and related matters are further allocated four sections – each headed by and officer of the rank of Additional Secretary or Joint Secretary/Director. The distribution of work in the sections is as follows:-

           (i)      ADMINISTRATION SECTION:

(a)    General Administration/Office Procedures.

(b)   Internal Administration

(c)    Administrative matters relating to Council of Ministers including allocation of rooms, furniture & furnishings, staff attachment of Ministers and VIPs.

(d)   Staff Grievances/Complaints against Home Department staff.

(e)    Personnel matters of State Guest House/Circuit House/Chintan Bhawan/Samman Bhawan.

(f)     Matters relating to Sikkim House/Rajya Sainik Board/Jails.

(g)    Allocation of office rooms and furniture/furnishings of other departments.

(h)    Uniform of Group “C” and “D” employees and drivers.

(i)      Telephone matters

(j)     Maintenance, cleanliness and security of Tashiling Secretariat building complex.

(k)   Information under RTI Act & Rules.

(l)      Monthly Coordination Meetings

(m)  Annual Report.

 

Section 4(b)(iii)- THE PROCEDURE FOLLOWED IN THE DECISION MAKING PROCESS, INCLUDING CHANNELS OF SUPERVISION AND ACCOUNTABILITY.

 

            As laid down under Manual of Office Procedure, 1998 and the Sikkim Government Service Rules, 1974, in respect of service matters, the Sikkim Financial Rules, 1979 in respect of financial matters and other Notifications and Office Orders issued from time to time. The Heads of Sections are accountable for any commission and omission.

 

Section 4(b)(iv) – THE NORMS SET BY IT FOR THE DISCHARGE OF ITS FUNCTIONS.

 

            All Heads of Sections have been directed to follow the law and rules as laid down and quote the same wherever necessary. Any difficulties are brought to the notice of the higher authorities.

Section 4(b)(vi) – A STATEMENT OF THE CATEGORIES OF DOCUMENTS THAT ARE HELD BY IT OR UNDER ITS CONTROL.

            The documents held by Home Department include relevant files on the subjects delt by  the Department already indicated.

 

Section 4(b)(vii) – PARTICULARS OF ANY ARRANGEMENT THAT EXISTS FOR CONSULTATION WITH, OR REPRESENTATION BY, THE MEMBERS OF THE PUBLIC IN RELATION TO THE FORMULATION OF ITS POLICY OR IMPLEMENTATION THEREOF.

            In respect of an important law public notice inviting comments is issued. Also expert opinion of the Law and other Departments, as may be necessary, is taken for framing of policy and its implementation.

 

Section 4(b)(viii) – STATEMENT OF THE BOARDS, COUNCILS, COMMITTEES AND OTHER BODIES CONSISTING OF TWO OR MORE PERSONS CONSTITUTED AS ITS PART OR FOR THE PURPOSE OF ITS ADVICE AND AS TO WHETHER MEETINGS OF THOSE BOARDS, COUNCILS, COMMITTEES AND OTHER BODIES ARE OPEN TO THE PUBLIC, OR THE MINUTES OF SUCH MEETINGS ARE ACCESSIBLE FOR PUBLIC.

              As notified in the gazette from time to time. Minutes of meeting are issued as per necessity.
